GSGI Family – Legal document for website and fundraiser

1. General Terms and Conditions (GTC)

1.1 Provider and scope

The following General Terms and Conditions (GTC) regulate the use of the online donation platform “GSGI Family”, operated by the sole proprietor Sergiu Prutean, Biberacherstr. 38/8, 89079 Ulm. The platform can be reached at https://gsgi-family.com/.

1.2 Subject of the contract

GSGI Family offers users the opportunity to make donations for charitable purposes. The platform acts as an intermediary between donors and recipient organizations. There is no direct contractual relationship between donor and recipient. The GSGI Family platform acts independently and responsibly. There are no contractual collaborations with the organizations mentioned as examples in the thematic areas.

1.3 Donation process

Donations are made using the online form provided on the platform. The donor can choose between different subject areas. GSGI Family runs 70 % of donation to selectedäkept meanucurrent organizations continue, wäduring 30 % remains with the platform operator as a brokerage commission. 1.4 Payment processing

Payments are made via external payment service providers (e.g. B. PayPal, Stripe, Klarna, VISA, Mastercard). The donor receivesäaccording to a payment confirmationäconfirmation and, if requested, a detailed invoice uAbout the brokerage commission. This commission is subject to sales tax unless a tax exemption applies.

1.5 Donation receipt

A tax-deductible donation receipt can only be issued for the portion forwarded to the non-profit organization (70 %) are issued. The exhibition takes place exclusivelyßby the respective receiving organization.

1.6 Use of the Platform

The use of the platform is on a voluntary basis. The operator reserves the right to check content, block user accounts and change or restrict functions.

1.7 Disclaimer

GSGI Family is not liable for the legal or tax qualification of donations made via the platform. Likewise, the platform is not liable for the success or the specific use of the donations by the beneficiary organizations. There is no guarantee that donations will be tax deductible. No liability is assumed for the content of external links or for statements made by the recipient organizations.

1.8 Data Protection

The separate regulations of the data protection declaration apply.

1.9 Changes to the Terms and Conditions

The provider reserves the right to change the terms and conditions at any time. Changes will be posted on the Platform and users will be notified of any material changes.

1.10 Final provisions

German law applies. The place of jurisdiction is Ulm, as far as legally permissible.

2. [LEGALLY NEW] Additional information on data protection, donation receipts, revocation and refunds

2.1 Data protection & data sharing

Personal data of donors (e.g. B. Name, Address, E-Mail) durfen gemyes Art. 6 Abs. 1 lit. a GDPR can only be passed on to receiving aid organizations if the donor does sour ausdruhas actually given his consent. Consent must be verifiable – For example, by clicking on a checkbox in the donation form with the note:

2.2 Donation receipts

A tax-deductible donation receipt will only be issued for the forwarded portion (70 %) issued.

It is only issued by the receiving organization if there is appropriate consent for the data to be passed on.

The 30 % of agency commission that remains with GSGI Family is not tax deductible, außA separate, tax-accounted invoice will be created.

2.3 Right to object

Donors have the right at any time to object to the processing of their personal data or to revoke their consent with future effect. Revocations should be sent to info.gsgifamili@gmail.com.

[Change]: A revocation only affects future data processing, not data that has already been transmitted.

2.4 Refund of donations

Donations are generally non-returnable and non-refundable.

GSGI Family acts independently and responsibly. There are no contractual collaborations with the organizations mentioned as examples. The distribution of donations is documented annually and made transparent upon request.

3. Donation policy (internal document)

3.1 Purpose

This donation policy regulates the thematic allocation and transparent use of donations collected via the “GSGI Family” platform. It serves internal procedural security and ensures that donations are forwarded according to the selection of donors and taking charitable criteria into account.

3.2 Structure

70 % of donations will go to selected…äheld, testedufte commonuforwarded to other organizations.

30 % of donations remain to cover platform costs (e.g. B. technical maintenance, personnel, marketing, sales tax burden).

3.3 Theme-based selection

Donors choose from the following (regularly adjustable) topic areas:

Animal protection worldwide

Medical care in crisis areas

Help for children in need

Disaster relief and emergency humanitarian aid

3.4 Organization selection

An internal committee made up of at least two members continuously checks the non-profit status, seriousness and transparency of potential recipient organizations. Criteria include:

Recognition of non-profit status in accordance with Sections 51 ff. AO

Membership in recognized donation alliances (e.g. B. HEART, VENRO)

Submission of annual reports and proof of use of funds

3.5 Voting and Allocation System

Donations are distributed based on the donors’ choice of topic. After the end of a campaign period, the donated amount is allocated internally to the respective organizations in proportion to the distribution of votes – without any public or legal connection to the organizations mentioned.

3.6 Payout and documentation

Payments to recipient organizations are usually made quarterly.

All transactions and use of funds are completely documented.

An annual transparency and use of funds report is created, which can be viewed upon request.

3.8 Additional Notes

The additional information on data protection, donation receipts, revocation and reimbursement in accordance with Section 2 also applies to the internal documentation of donations. Refunds in the event of technical errors will be made exclusively in accordance with the conditions set out in the Terms and Conditions.

3.9 Note

There is no cooperation with the organizations mentioned or verified. The assignment takes place exclusively internally within the framework of the platform structure and thematic focus.
